Know Your Rights: Emotional Support Animals

Emotional Support Animals (ESAs) provide comfort for mental or emotional disabilities such as anxiety, depression, or PTSD. Unlike service animals, ESAs are not trained for specific tasks.

Public Access: Under the ADA, ESAs are not service animals and do not have access rights to restaurants, stores, hotels, or hospitals.

Housing: The Fair Housing Act (FHA) requires landlords to make reasonable accommodations — waiving pet bans, deposits, and breed restrictions. Documentation from a licensed health professional may be requested when the need isn’t obvious.

Air Travel: Airlines are not required to recognize ESAs in cabins since 2020; they now travel under standard pet policies and fees.

Federal & Virginia: State law follows federal standards — no public access, but full housing protections enforced by the Virginia Fair Housing Office and local jurisdictions.

Bottom line: ESAs may not go everywhere, but in your home they’re a federally protected lifeline.
